Based on articles 29 and 20 of Law no. 03/L-072 on Local Elections in Republic of Kosovo and article 64.2 items (a) and (b) of Law no. 03/L-073 for General Elections in Republic of Kosvo and Law 03/L-256 on Amendment of Law no. 03/L-073 on General Election in Republic of Kosovo, Central Election Commission on 02.07.2013 issues: ELECTION REGULATION No. 10 / 2013 SECOND ROUND OF ELECTIONS FOR MUNICIPAL MAYOR Article 1 General Provisions This Regulation is intended to regulate, election observers, appointment of polling station committees, Voters List, voting and counting in polling stations, voting for people with special needs and circumstances, as well as the campaign spending limits and financial disclosure of Political Party for the Second Round of Elections for Municipal Mayor. Article 2     Definitions 2.1 Second round of mayoral elections – mean the elections held between the two candidates in the mayoral election who won the highest number of votes in the municipality where no candidate has obtained at least 50% plus one (1) vote of the total number of valid votes cast in the municipality in accordance with Article 9.6 of the Law on Local Elections in the Republic of Kosovo. 2.2 The campaign period for the second round of mayoral elections means the period of time prescribed by the CEC decision to allow political parties to conduct their election campaign for the second round of mayoral elections. Article 3 Applicable procedures 3.1 All provisions in the relevant election regulations of the CEC are applicable during the second round of Mayoral elections, unless they are replaced or amended specifically by this Regulation. Article 4 Election observers 4.1 Observers accredited before Election Day of the first round, can observe the second round of mayoral elections. 4.2 Representatives of certified political entities, NGOs, governmental and intergovernmental organizations, international organizations that are specialized and involved in protection of human rights, foreign countries or media, can apply to Central Election Commission (CEC) to get accredited to observe the second round of mayoral elections, or if they are already an accredited observer organization may submit a request for additional accreditation, no later than five (5) days before the Day Election. Article 5 Appointment of Polling Station Committees 5.1 In every polling station one (1) Polling Station Committee (PSC) will serve, which will reflect the composition of the MEC as defined with article 74.1 of Law on General Elections in Republic of Kosovo. For the second round of municipal mayor elections article 74.2 of Law on General Elections in Republic of Kosovo is not applicable. 5.2 Secretariat of CEC will request from Political Entities to confirm the Appointed List of members of PSC’s from the first round and propose eventual changes and to present it to CEC for approval not later than fourteen (14) days before Election Day. 5.3 Both candidates that compete in the second round of municipal mayor elections will be allowed to have their representatives in PSC, pursuant to decision of CEC. Political entities of candidates must nominate their representatives. If there are no sufficient nominations received from that political entity, then the composition of PSC will remain as defined in article 4.2 of this Regulation. 5.4 CEC will appoint 10% of general number of PSC members, defined in article 4.2 above, as reserve members of PSC. Reserve members of PSV must be selected among members of PSC that have served in the counting teams and/or in voting teams or as reserve members for Municipal Elections. 5.5 CEC will appoint teams of PSC’s not later than seven (7) days before Election Day based on recommendations that are received from SMEO’s Article 6 Voter’s List The same voter’s list that was used for Municipal Elections will be used for the second round of Municipal Mayor Elections. Article 7 Voting and counting inside Polling Stations 7.1 In those municipalities where the second round will take place, the number of polling centers and their locations must be the same as they were in Municipal Elections. 7.2 Members of PSC will undertake two actions as team of voting and as team of counting 7.3   With the aim of reconciliation of polling station results, during the second round of elections for municipal mayor the result and reconciliation form will be used (RRF) one copy of which is attached to this Regulations as Annex 1. 7.4 The voter will vote by marking one of the candidates in the ballot, in absence of ballots printed with names of candidates that compete for the second round, voters will vote by marking in the ballot the number of the candidate, name and surname of the candidate and/or name of political entity of the candidate. 7.5 Ballot will be considered invalid as defined with article 15.10 of Election Regulation of CEC no. 09/2013 “Voting and Counting inside Polling Stations”. Except others, if the name and surname of the candidate or name of the political entity written in the ballot are not of the same candidate, ballot is invalid. Article 8 Out of Kosovo Voting All the voters who are successfully registered as voters for voting abroad can vote for the second round of mayoral elections, if they belong to the municipality which will be held the second round of mayoral elections. Article 9 Voting of persons with special needs and circumstances Only eligible voters who are registered successfully as SNCV voters for Municipal Elections in accordance with Article 2.1 of the Election Regulation no. 04/2013 “Voting of persons with special needs”, can vote in those municipalities where second round of mayoral elections will take place. Article 10 Limiting campaign spending and financial disclosure In addition to the requirements specified in the Election Rule no. 12/2013 Limiting campaign spending and financial disclosure, all political parties whose candidates have qualified for the second round of mayoral elections, shall submit to the Office the completed form of Campaign Financial Disclosure for the period that starts from the first day after the day of the first round elections and ending on the day of the second round mayoral elections, not later than forty-five (45) calendar days after the elections. Article 10 Final and Transitional Provisions 10.1 With entry into force of this regulation, the Election Regulation no. 10/2009 Second Round of Municipal Mayor Elections dated 29.06.2009 is abolished 10.2 An integral part of this Regulation is: Annex - I   Result and Reconciliation Form (RRF) Article 11 Entry into force This Regulation enters into force on 02.07.2013 President of Central Election Commission Valdete Daka 2 1
